1. INFORMATION FOR THE USER

Who is the data controller for your personal data?
PaynoPain Solutions SL is the DATA CONTROLLER for the processing of the USER’s personal data and hereby informs that said data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR), and Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data and on what legal basis?
Depending on the form through which your personal data has been collected, it will be processed confidentially for the following purposes:

• Contact form
  • To respond to inquiries or any type of request submitted by the user via the contact forms available on the controller’s website. (Legitimate interest of the controller, Art. 6.1.f GDPR)
  • To conduct statistical analyses and market research. (Legitimate interest of the controller, Art. 6.1.f GDPR)
• Curriculum submission form
  • To allow the data subject to participate in recruitment processes and analyze the applicant’s profile with the purpose of selecting the most suitable candidate for the vacancy. (Consent of the data subject, Art. 6.1.a GDPR)

How long will we retain your personal data?
The data will be kept for no longer than necessary for the purpose for which it was collected, or for as long as required by applicable legal obligations. Once no longer needed, the data will be securely deleted or anonymized.

To whom do we disclose your data?
No personal data will be communicated to third parties unless it is necessary for fulfilling the purposes of the processing or required by law. Where applicable, data may be disclosed to service providers with whom the CONTROLLER has entered into confidentiality and data processing agreements in accordance with current data protection regulations.

What are your rights?
The USER has the following rights:

• The right to withdraw consent at any time.
• The right to access, rectify, transfer and delete their data, and to restrict or object to its processing.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if they believe the data processing does not comply with applicable legislation.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By checking the relevant boxes and filling in data fields marked with an asterisk (*) in contact forms or download forms, USERS expressly, freely and unequivocally accept that their data is necessary to fulfill their request. The inclusion of data in the remaining, non-mandatory fields is optional. The USER guarantees that the personal data provided is truthful and agrees to communicate any changes to such data.

The CONTROLLER informs that all data requested via the website is mandatory, as it is necessary to provide optimal service to the USER. If all required data is not provided, it cannot be guaranteed that the information and services offered will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with current personal data protection regulations, the CONTROLLER complies with all GDPR and LOPDGDD provisions for the processing of personal data under its responsibility. In particular, the CONTROLLER adheres to the principles outlined in Article 5 of the GDPR, ensuring that personal data is processed lawfully, fairly and transparently, and is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

The CONTROLLER guarantees that appropriate technical and organizational policies have been implemented to apply the security measures required by the GDPR and the LOPDGDD to protect the rights and freedoms of USERS and that USERS have been provided with the necessary information to exercise those rights.
